These are all too common responses to mediation. The reality is however nothing is guaranteed in commercial litigation or even in a dispute before it becomes litigious and lawyers get involved. Its hassle/disruptive, expensive (cash flow and otherwise) and uncertain.
Statistics aside, the majority of mediations work and the parties get closure csooner rather than later, save expense, face and disruption to thier business. Medaition allows commerciality to replace the expensive uncertainty of litigation (which in reality nobody wants).
