Utilities Contracts - Are You Checking Your Terms & Conditions?

Let's talk about Terms and Conditions..

And no — not the endless pages we all scroll past when our phones update (does anyone read those).

I mean the terms and conditions behind your energy supply contract… and just as importantly, the ones behind your broker’s agreement.

In energy procurement, the conversation often becomes a race to the cheapest price. Sometimes that works out and sometimes it doesn’t.

A good consultant doesn’t just chase a rate. They take the time to understand your plans, operational pressures, servicing needs and future scenarios — then match the right supplier, the right contract structure and the right terms to protect your business and manage risk properly.

What many companies miss is that brokers have their own terms and conditions too. And these need just as much scrutiny as the supply contract.

I’ve seen clauses that allow:

  • Significant penalties for cancelling a contract
  • Exclusive procurement rights handed to the broker

Sometimes none of this is made clear. It presents a lack of choice & control – and that’s a big risk to business outside of large commission fees.

That’s why businesses should consider working with Stratagem. We don’t just look at price — we look at exposure, contract risk, hidden obligations, and future impact. Our role is to ensure you retain choice, maintain control, and understand exactly what you’re signing up to. No surprises. No ambiguity.

Whenever you engage with a counter party — supplier, broker or consultant — make sure you’re reviewing the terms of engagement with the same diligence you apply to price.

It’s one of the simplest ways to reduce unnecessary risk and ensure accountability sits on both sides of the table.

I founded Stratagem after having worked with energy suppliers and consultants for 20 years that I wanted to build something different.
